DE C.V. known commercially as "LioMart" (hereinafter referred to as "LioMart") through this document, describes the general terms and conditions (the "Terms and Conditions"), which regulate the provision of information and services provided to Users through its website, whose domain is www. (the “Domain”). Any person who expresses their intention to access and/or use the services offered in the Domain will be subject to the provisions of the Terms and Conditions, in addition to all the policies and principles that govern Lio Mart and that are incorporated by reference. 1.- Reserves LioMart declares to be the sole owner of this Domain, so it is reserved in its favor, the power to carry out at any time and without the need for prior notice to the User, modifications, elimination of content or services and updates of the information contained therein, as well as its configuration or format. 2.- Users The use of the Domain or any of its contents included in it, means the User's acceptance without reservation of each and every one of the general conditions that make up these Terms and Conditions. In the event that the User does not fully and absolutely accept the Terms and Conditions, which are mandatory and binding, they must refrain from accessing the Domain and/or using the Services. By accepting these Terms and Conditions, the User agrees that he has read, and accepts all the conditions established in said document in addition to the Privacy Notice and all the documents incorporated by reference. 3.- Conditions of Use The User is obliged to use the Website as well as its content, diligently in accordance with Mexican laws, and conduct themselves in accordance with morality and good customs, public order, as well as for everything provided in these Terms and Conditions, so you must refrain from using them in any way that could prevent the normal operation and enjoyment by Domain Users, or in any way that could injure or cause damage to the assets and rights of Lio Mart, its current or potential customers, Users and any other third party. The purposes of the Domain are limited to publicizing the products offered by Lio Mart to the general public or to potential customers. On some occasions Lio Mart may offer services for which the Domain User must create an Account and select an access code. Lio Mart is not responsible for the improper use of the Account by persons other than the Users. The use that is given to the Access Code and the Account is the entire responsibility of the Users, so that any obligation contracted in the Domain using the information system provided for this purpose will be understood to be carried out by the User to whom the Account corresponds. . The User is obliged to notify LioMart reliably and by acknowledgment of receipt regarding any unauthorized use of his Account, including the entry or transfer of information by unauthorized third parties to it. The Account may not be subject to transfer under any title. LioMart may at any time reject the creation of an account, cancel the registration in the Domain of any Account previously accepted, and temporarily suspend access to any User or Account, without being obliged to state the reasons for its decision. The User waives any right to compensation or compensation. 4.- Modifications to the Terms and Conditions Lio Mart may modify these Terms and Conditions at any time and unilaterally. It will be understood that the User expresses his consent when entering the Domain after the date on which the modifications of these Terms and Conditions were published or notified. 5.- Intellectual and Industrial Property LioMart is the owner of all the creative content in the Domain, corresponding to trademarks, domain names, commercial notices, signs, texts, logos, color combinations, databases or in general any information or element distinctive contained in the Domain. The User is prohibited from modifying, altering or deleting, in whole or in part, any part of the referred content. The improper use and total or partial reproduction of said contents are prohibited, unless expressly authorized in writing by Lio Mart, as provided in the Industrial Property Law. Furthermore, it is prohibited for the User to carry out any type of reverse engineering, sublicense or transmit in any way, translate or carry out works derived from the computer programs necessary for the operation, access and use of this Website and its contents. and services included therein, as well as carrying out, with respect to all or part of such programs, any of the acts of exploitation referred to in the preceding paragraph. The Domain User must refrain in any case from deleting, altering, evading or manipulating any protection device or systems that may be installed in it. 6.- Personal Data of the User The Users agree to complete with total veracity, and validity those items that LioMart has for the transfer of their personal data, related to the treatment and purposes described in the corresponding Privacy Notice. The User undertakes to provide the information described above in an exact, precise and true manner; in addition to updating them as necessary. Those items of information that LioMart has and that have been described in the previous paragraph will hereinafter be referred to as "Personal Data". The User accepts and is aware of his responsibility for the veracity, accuracy, validity and authenticity of the Personal Data. LioMart may at any time initiate the legal and/or verification procedures that, in its discretion, correspond in the event that it considers that any User has failed to comply with the obligation described above. LioMart may, when it deems it necessary, request additional information or documentation from the User to corroborate the information entered as Personal Data. 7.- Responsibility LioMart expresses its commitment to the User to guarantee the availability and continuity of the Domain, as well as its content and tools, so that they function correctly at all times, so that the User can access and use them in a fast, uninterrupted and error-free.LioMart does not grant any guarantee regarding the suitability and content of the Domain or any of the services linked to it for the satisfaction of the specific needs of the User LioMart ensures that this Domain is free of all types of content that is dangerous or inappropriate for minors. LioMart will examine the domain continuously in search of the presence of viruses or other harmful elements that could cause alterations in the User's computer system, in its electronic documents or in its databases. However, LioMart does not guarantee the absence of such elements, so it will not be responsible for any damages that this may cause. 8.- Product Warranty LioMart guarantees that the products are of excellent quality, 100% natural, without added sugar and gluten free, will be delivered free of defects, since each product that LioMart makes is done competently and diligently according to quality that characterizes it. The guarantee for the products will expire after 2 (two) days from the date of delivery, regarding the quality of the fruit, once this period has elapsed, no claims or returns of any kind will be accepted. If the products do not satisfy the previous guarantee, Lio Mart will replace the defective products, as long as the customer notifies said non-conformity by means of an email attaching images of the product, description of the situation, guide number and order number before the end of the warranty period. 9.-Shipping and Delivery Times Once the order is placed, the shipment will be made the next business day from the date on which the payment of the product is made. Once the product has been delivered to the corresponding parcel, the delivery time is approximately 2 (two) to 5 (five) business days. Delays caused by internal situations of the parcel will not be the responsibility of LioMart. 10.- Billing At LioMart we accept the following forms of payment: The invoice is processed in the same month in which the purchase is made, after that period it cannot be issued. Therefore, we suggest you request it during the confirmation of your purchase. If the customer requests his invoice after 30 calendar days of delivery, it can no longer be issued by our System. Therefore, we suggest our customers take their precautions and request it as soon as the order is placed. 11.-Jurisdiction and Applicable Law This agreement of wills will be governed and interpreted in accordance with the Commercial Code and by the Federal Civil Code; and for its interpretation and compliance, the Parties expressly submit to the competent Courts in the State of Jalisco.
